Terms of Service

These terms govern your use of TrelloDial, the power dialer for Follow Up Boss operated by The Ludify Group in Charleston, South Carolina ("TrelloDial", "we", "us"). By creating an account or using the service you agree to them on behalf of yourself and, if you sign up for a team, on behalf of that team.

1. Your account

You must be 18 or older and provide accurate information. You are responsible for everything done under your account and for keeping your password and Follow Up Boss API key confidential. Team admins can invite and remove team members and are responsible for their team's use of the service.

2. Follow Up Boss

TrelloDial connects to your Follow Up Boss account using an API key you provide. You confirm that you are permitted to use that account and to share its data with us. TrelloDial is an independent product and is not affiliated with, endorsed by or supported by Follow Up Boss.

3. Calling rules and consent

You place the calls. You are solely responsible for making sure your calling complies with the laws that apply to you and to the people you call, including:

• the Telephone Consumer Protection Act (TCPA), state telemarketing laws and calling-hour rules;
• the National Do Not Call Registry and any state or internal do-not-call lists;
• call recording laws, including states that require every party's consent before a call is recorded; and
• your brokerage's and MLS's rules on contacting consumers.

Calls placed through TrelloDial are recorded and transcribed when recording is turned on for your team. Team admins can turn recording off in Settings. If you keep it on, you are responsible for giving any notice the law requires.

4. Acceptable use

You agree not to use TrelloDial to place unlawful, harassing, fraudulent or deceptive calls; to spoof or misuse caller IDs; to dial numbers you do not have the right to call; to probe or disrupt the service; or to resell access without our written permission. We may suspend accounts that put the service, our carrier relationships or other customers at risk.

5. Phone numbers

Dialing numbers provisioned through TrelloDial are assigned to your team for use in the service and remain under our carrier account. Personal numbers you verify as caller IDs must be numbers you own or are authorized to use.

6. Plans, trials and fees

During early access the service is free and subject to the trial limits shown in the app. If we introduce paid plans we will tell you the price and terms before anything is charged, and you will be able to stop using the service instead. We may change plan limits with reasonable notice.

7. Your data

Your contacts, recordings, transcripts and notes are yours. You give us the right to store and process them only to provide the service, as described in our Privacy Policy. You are responsible for having the rights and consents needed to bring that data into TrelloDial.

8. Availability and changes

We work to keep TrelloDial available and to fix problems quickly, but the service is provided "as is" and "as available" without warranties of any kind, including uptime, that calls will connect, or that recordings, transcripts or AI notes will be accurate or complete. AI-generated notes are suggestions and should be checked before you rely on them. We may change or discontinue features with reasonable notice.

9. Limitation of liability

To the fullest extent the law allows, TrelloDial and The Ludify Group are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or one hundred dollars if you have paid nothing.

10. Indemnity

You will defend and hold harmless TrelloDial and The Ludify Group from claims, fines and costs arising from calls you place, data you bring into the service, or your breach of these terms, including claims under telemarketing, do-not-call or call-recording laws.

11. Termination

You can stop using TrelloDial and ask us to delete your team's data at any time. We may suspend or end your access if you breach these terms or if the service is discontinued. Sections 3, 7, 9, 10 and 12 survive termination.

12. General

These terms are governed by the laws of the State of South Carolina, and any dispute will be brought in the state or federal courts located in Charleston County, South Carolina. If a part of these terms is found unenforceable, the rest still applies. These terms, with the Privacy Policy, are the whole agreement between you and us about the service. We may update them; for material changes we will notify team admins by email and update the date above.
